By placing an order through this Website, you (hereinafter, the "Customer" or "you") acknowledge that you have read, understood, and accepted these General Terms. These General Terms form an integral part of the contract between you and Cathy Rocks.

2. SCOPE OF APPLICATION

These General Terms apply exclusively to contracts concluded between Cathy Rocks and consumers for the sale of products through this Website.

4. PLACING AN ORDER AND CONTRACT FORMATION

4.1 Order Process

To place an order, you must complete the online purchasing process and confirm your acceptance of these General Terms before submitting your order.

4.2 Contract Formation

The sales contract is concluded once Cathy Rocks sends you an email confirming acceptance of your order.

Cathy Rocks reserves the right to refuse or cancel an order where necessary for legal compliance, fraud prevention, payment issues, stock unavailability, pricing errors, or other legitimate business reasons.

4.3 Orders Placed Through the Author

If you expressly request that Cathy Rocks purchase author copies from Amazon on your behalf, you consent to the sharing of your delivery information (name, delivery address, and telephone number where required) with Amazon solely for the purpose of fulfilling your request.

You are under no obligation to purchase books through Cathy Rocks and may instead purchase directly from Amazon.

5. PRICES AND PAYMENT

5.1 Prices

All prices displayed on the Website are shown in Euros (€) and include Value Added Tax (VAT), where applicable.

Delivery charges, where applicable, are displayed separately before you confirm your order.

5.2 Payment

Payment must be completed using one of the payment methods offered during checkout.

All payments are subject to validation and authorization by the relevant payment service provider.

6. DELIVERY

6.1 Delivery of Physical Products

Orders will be delivered to the shipping address provided during checkout.

Delivery times are estimates only and may vary depending on the destination and carrier.

Unless otherwise agreed, physical products will be delivered within a maximum of 30 calendar days from order confirmation.

6.2 Delivery of Digital Products

Digital products (such as downloadable content) will be made available for download immediately after payment is confirmed, unless otherwise stated.

6.3 Delays or Unavailability

If delivery cannot be completed within the expected timeframe, Cathy Rocks will inform you as soon as reasonably possible and offer you the option to:

  • Continue waiting for delivery; or
  • Cancel your order and receive a full refund.

If a product becomes unavailable after your order has been accepted, you will receive a full refund without undue delay.

7. RIGHT OF WITHDRAWAL

7.1 Withdrawal Period

Consumers have the right to withdraw from the purchase contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after you, or a third party designated by you (other than the carrier), acquire physical possession of the goods.

7.2 Exercising Your Right

To exercise your right of withdrawal, you must notify Cathy Rocks by email or post using the contact details provided in Section 16.

A clear statement communicating your decision to withdraw is sufficient. You may use the model withdrawal form provided below, but it is not mandatory.

7.3 Effects of Withdrawal

If you withdraw from the contract, Cathy Rocks will reimburse all payments received from you, including the cost of standard delivery (excluding any additional costs resulting from your choice of a more expensive delivery method).

Refunds will be made using the same payment method originally used unless otherwise agreed.

Cathy Rocks may withhold reimbursement until the returned goods have been received or satisfactory proof of return has been provided.

7.4 Return of Goods

You must return the goods to Cathy Rocks without undue delay and in any event no later than 14 calendar days from the date on which you communicate your withdrawal.

The direct cost of returning the goods shall be borne by you.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7.5 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Personalised or custom-made products;
  • Sealed goods which are unsuitable for return for health or hygiene reasons after being unsealed;
  • Goods which become inseparably mixed with other items after delivery;
  • Digital content where you have expressly consented to the download or streaming and acknowledged that you lose your right of withdrawal;
  • Any other products excluded from the right of withdrawal under applicable consumer legislation.

8. LEGAL GUARANTEE

In accordance with Spanish consumer legislation (Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users), all new consumer goods are covered by a three-year legal guarantee from the date of delivery.

8.1 Scope of the Guarantee

If a product does not conform to the contract, you are entitled, where applicable, to:

  • Repair of the product;
  • Replacement with a conforming product;
  • An appropriate price reduction; or
  • Termination of the contract (rescission).

8.2 Presumption of Conformity

During the first two years after delivery, any lack of conformity is presumed to have existed at the time of delivery unless proven otherwise or unless such presumption is incompatible with the nature of the goods or the defect.

8.3 Second-Hand Goods

If second-hand goods are sold, the legal guarantee period shall be one year from the date of delivery, unless otherwise agreed between the parties.

9. LIABILITY

Nothing in these General Terms excludes or limits liability where such exclusion or limitation would be unlawful under applicable law, including liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any other liability which cannot be excluded or limited by law.

To the fullest extent permitted by law, Cathy Rocks shall not be liable for indirect or consequential losses arising from the use of this Website or the products sold through it.

Force Majeure

Cathy Rocks shall not be liable for delays or failures to perform obligations where such delays or failures result from circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, strikes, pandemics, governmental actions, interruptions to transport services, or failures of communication networks.

10. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content published on this Website, including text, illustrations, graphics, logos, photographs, book covers, designs, software, downloadable materials, and other creative works, is the property of Cathy Rocks or its licensors and is protected by applicable Spanish, European Union, and international intellectual property laws.

The names Cathy Rocks, associated logos, artwork, book titles, illustrations, and other distinctive signs are protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, published, or otherwise used without prior written permission from Cathy Rocks, except where permitted by law.

11. DATA PROTECTION

Personal data collected through this Website are processed in accordance with our Privacy Policy and Cookie Policy, the General Data Protection Regulation (GDPR), and applicable Spanish data protection legislation.

These General Terms shall be governed by and interpreted in accordance with the laws of Spain.

Where the Customer acts as a consumer, any dispute shall be submitted to the courts and tribunals corresponding to the Customer's place of residence, in accordance with applicable consumer protection legislation.

Where the Customer is not acting as a consumer, the parties expressly submit to the jurisdiction of the courts and tribunals of Málaga, Spain, waiving any other jurisdiction that may otherwise apply.

15. SEVERABILITY

If any provision of these General Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Any invalid provision shall, where possible, be interpreted or replaced so as to achieve the original commercial intent while remaining legally enforceable.
